Introduction

These terms and conditions govern the use of the Property Marketing Floor Plan services provided by PDC, a business registered in Queensland, Australia, as Pure Design Concepts Australia Pty Ltd with the ABN: 94 660 137 217.

By using our services, you agree to be bound by these terms and conditions. If you do not agree with these terms and conditions, please do not use our services.

Services

PDC provides Property Marketing Floor Plan services to its clients.

The services include creating and delivering digital marketing floor plans of properties.

PDC measures the property onsite or the client provides us with architectural plans to create the floor plan.

PDC reserves the right to modify or discontinue any aspect of the services at any time, without notice or liability.

Client Obligations

The client is responsible for providing accurate information about the property to be marketed, including requests for alterations and or verbal or written specifications.

The client must provide PDC with access to the property or architectural plans to create the floor plan.

The client must ensure that they have the necessary rights and permissions to allow PDC to use the property information for marketing purposes.

Fees and Payment

PDC's fees for its services are outlined on its price list.

The client agrees to pay the fees in full and within 14 days of delivery of the final product.

The individual or authorised representative engaging PDC's services is responsible for ensuring timely payment. They are also obligated to adhere to the internal administrative processes of their respective organisation to guarantee payment within the stipulated terms. Should payment not be received within these terms, PDC reserves the right to re-issue invoices to the primary entities or individuals.

PDC reserves the right to suspend or terminate services if fees are not paid in full and within 14 days of delivery of the final product.

PDC reserves the right to charge late fees of $2.00 AUD per calendar day, of which the sum is overdue if fees are not paid in full and within 14 days of delivery of the final product.

Intellectual Property & Copyright

PDC retains all intellectual property rights in the floor plans created for the client.

The client is granted a non-exclusive, non-transferable, revocable license to use the floor plans for marketing purposes only.

The client must not use the floor plans for any other purpose without the prior written consent of PDC.

Limitation of Liability

PDC is not liable for any loss, damage, or expense arising from the use of its services, including but not limited to errors, omissions, or inaccuracies in the floor plans.

The client is responsible for verifying the accuracy and completeness of the floor plans before using them for marketing purposes.

Governing Law and Jurisdiction

These terms and conditions are governed by the laws of the state or territory of which the booking was made, as dictated by the property address. If the property is not located in Australia, then the default jurisdiction is Queensland.

Any disputes arising from these terms and conditions will be subject to the exclusive jurisdiction of the courts of the state or territory of which the booking was made, as dictated by the property address. If the property is not located in Australia, then the default jurisdiction is Queensland.

Entire Agreement

These terms and conditions constitute the entire agreement between PDC and the client.

These terms and conditions supersede all prior agreements, negotiations, and understandings, whether oral or written, between PDC and the client.

Entity Disclosure
​
PDC is associated with and forms part of a group of entities, individuals and trusts with primary interests in Property Marketing and Development services. All PDC's interested parties are Australian residents for taxation purposes.
